These Terms And Condition Amount To An Electronic Record In The Form Of An Electronic Contract Formed Under Information Technology Act, 2000 And The Rules Made Thereunder As Applicable And The Amended Provisions Pertaining To Electronic Documents/Records In Various Statutes As Amended By The Information Technology Act, 2000. These Terms And Conditions Do Not Require Any Physical, Electronic Or Digital Signature. The User Understands And Agrees That Vyomeen Media Pvt. Ltd. Is An “Intermediary” As Defined Under The Information Technology Act, 2000. These Terms And Conditions Are Published And Shall Be Construed In Accordance With The Provisions Of Rule 3(1) Of The Information Technology (Intermediaries Guidelines) Rules, 2011 Under The Information Technology Act, 2000 That Require Publishing The Rules And Regulations, Privacy Policy And User Agreement For Access Or Usage Of The Intermediary’s Computer Resource By Any Person. If You Use The NewsReach And Avail Our Services In Any Way, You Accept, Agree To Comply With And Be Bound By These Terms And Conditions Which Form A Binding Agreement Between You And Vyomeen. If You Do Not Wish To Be Bound By This Agreement, Please Do Not Access And Use NewsReach In Any Way. This Agreement May Be Modified From Time To Time At The Sole Discretion Of Vyomeen. It Is Your Responsibility To Review The Agreement From Time To Time. If You Continue To Use NewsReach, After Notice Of Change Has Been Intimated Or Published On NewsReach, As The Case May Be, You Thereby Provide Your Consent To The Changed Practices And Terms. For This Reason, We Encourage You To Review The Agreement Each Time You Access And Use NewsReach.

Registration:

In Our Registration Process, We Shall Ask You For Contact And Other Personal Information, Including Without Limitation Your Name, Email Address, Phone Number, Etc. To Enable You To Use NewsReach  And/Or Send You Materials Or Information About NewsReach And/Or Us. We Shall Ask You For Demographic Information, Such As Your Age Or Gender, For Internal Profiling Purposes. We Reserve The Right To Share The Information And Data Submitted By You With Our Bona Fide Users And Third-Party Partners, Affiliates, Advertisers, And Sponsors.

Limitations On Usage:

The User Agrees And Undertakes Not To Reverse Engineer, Modify, Copy, Distribute, Transmit, Display, Perform, Reproduce, Publish, License, Create Derivative Works From, Transfer, Commercialise, Or Sell Any Information Or Software Obtained From NewsReach. With Respect To Any And All Types Of Users, Unlimited Or Wholesale Reproduction, Copying Of The Content For Commercial Or Non-Commercial Purposes, And Unwarranted Modification Of Data And Information Constituting The Content Of NewsReach Is Not Permitted. User Conduct And Rules:

By Using NewsReach, The User Undertakes That He/She Is Aged 18 Years Of Age And That Irrespective Of The Type Of User, He/She Will Not:

1. defame, abuse, harass, stalk, threaten, any other person and/or entity or otherwise violate the legal rights of others;
2. publish, post, upload, distribute, transmit, communicate, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material, data, content, or information;
3. provide inaccurate, misleading, or false information to us or to any other user or submit the same with the intention of it being published by NewsReach. If data, information, or content provided by the user subsequently is rendered inaccurate, misleading, or false, then the user shall promptly notify us about the same and bring about rectifications as may be required by us;
4. upload files that contain software or other material protected by intellectual property laws unless he/she owns or controls the rights thereto or has received all necessary licenses pertaining thereto;
5. upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of NewsReach or another’s computer and other such electronic devices;
6. falsify or delete any legal or other formal notices, or proprietary designations or labels of the origin or source of software or other material that is uploaded by NewsReach;
7. harass, annoy, threaten, defame, or intimidate any other users;
8. conduct himself/herself in a manner which is defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, or otherwise objectionable, whether in relation to the data, information, or content uploaded or transmitted by the user in any manner, or otherwise;
9. promote or enable illegal or unlawful activities of any kind;
10. intend or attempt to obstruct, defraud, swindle, or deceive us or other users in any manner whatsoever;
11. impersonate, or otherwise misrepresent affiliation, connection or association with, any person or entity;
12. solicit gambling or engage in any gambling or similar activity on NewsReach;
13. engage in spamming, spimming, phishing, trolling, or similar activities;
14. violate any applicable laws or regulations for the time being in force in or outside the territory of the Republic India; and
15. violate any of the Terms contained herein.

User Warranty And Representation:

The User Guarantees, Warrants, And Certifies That The User Is The Owner Of The Content, Information, Or Data Which The User Submits, And That It Does Not Infringe Any Legal Or Statutory Rights Of Others, Including Without Limitation Intellectual Property Rights, And That The Content, Information, Or Data Which The User Submits Is True, Authentic, And Accurate. The User Further Warrants That To His/Her Knowledge, No Action, Suit, Proceeding, Or Investigation Has Been Instituted Or Threatened Relating To Any Content, Information, Or Data Submitted On NewsReach.

We Hereby Disclaim Any Guarantees Of Exactness As To The Efficiency Of The Services Offered By Us Directly To The Users, And/Or Indirectly Through Some Of Its Users, To The Other Remaining Users.
